Comme pour chaque <\/span><a href=\"https:\/\/www.jimprimeenfrance.fr\/blog\/les-differents-supports-de-communication-print-et-leurs-enjeux\/\"><b>support de communication print<\/b><\/a><span style=\"font-weight: 400;\">, le <\/span><b>flyer<\/b><span style=\"font-weight: 400;\"> a aussi son lot de <\/span><b>mentions l\u00e9gales<\/b><span style=\"font-weight: 400;\"> obligatoires \u00e0 faire appara\u00eetre. Le respect de la r\u00e8glementation est un d\u00e9tail \u00e0 ne pas n\u00e9gliger. En effet, en cas de non respect, vous vous exposez \u00e0 des p\u00e9nalit\u00e9s financi\u00e8res. Les <\/span><b>mentions obligatoires<\/b><span style=\"font-weight: 400;\"> sont donc indispensables \u00e0 la cr\u00e9ation de vos<\/span><b> flyers publicitaires<\/b><span style=\"font-weight: 400;\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Pour vous aider, nous avons donc fait un r\u00e9cap\u2019 de toutes les <\/span><b>mentions l\u00e9gales<\/b><span style=\"font-weight: 400;\"> \u00e0 faire appara\u00eetre sur vos <\/span><b>flyers<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>Les informations concernant votre soci\u00e9t\u00e9\u00a0<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Selon les articles <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000017843957\/2007-12-30\"><span style=\"font-weight: 400;\">R123-237 et R123-238 du Code du Commerce<\/span><\/a><span style=\"font-weight: 400;\">, toute personne, morale ou physique, immatricul\u00e9e au Registre du Commerce et des Soci\u00e9t\u00e9s doit renseigner les informations suivantes :<\/span><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">La d\u00e9nomination sociale (nom de votre soci\u00e9t\u00e9) ainsi que l\u2019adresse du si\u00e8ge social ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">Le num\u00e9ro R.C.S suivi de la ville o\u00f9 est enregistr\u00e9e l\u2019immatriculation ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">La forme juridique pour les entreprises (SAS, EURL, SARL) ainsi que le num\u00e9ro SIREN ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">Le montant du capital social pour les soci\u00e9t\u00e9s commerciales.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">En cas de manquement d\u2019une de ces mentions, vous encourez le risque de recevoir une amende de 750 euros.<\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>Les mentions l\u00e9gales concernant votre imprimeur<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">L<\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000000877119\/\"><span style=\"font-weight: 400;\">\u2019article 3 de la loi du 29 juillet 1881<\/span><\/a><span style=\"font-weight: 400;\"> stipule que le nom et l\u2019adresse de l\u2019imprimeur doivent \u00eatre appos\u00e9s sur vos <\/span><b>flyers<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Par exemple, si vous faites le choix d\u2019imprimer chez <\/span><a href=\"https:\/\/www.jimprimeenfrance.fr\/\"><span style=\"font-weight: 400;\">PrintBasPrix<\/span><\/a><span style=\"font-weight: 400;\">, vous devez ajouter la mention \u201cImprim\u00e9 par PrintBasPrix &#8211; 111 rue Nicolas Louis Vauquelin, 31100 TOULOUSE\u201d.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Si vous imprimez vous-m\u00eame vos<\/span><b> flyers<\/b><span style=\"font-weight: 400;\">, vous devez indiquer la mention \u201cimprim\u00e9 par nos soins\u201d ou \u201cIPNS\u201d.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">En cas de non-respect de ces obligations, la sanction est de 3750 euros.<\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>Les mentions l\u00e9gales environnementales<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">Contrairement \u00e0 ce que l\u2019on peut penser, les mentions \u201cNe pas jeter sur la voie publique\u201d et \u201cImprim\u00e9 sur du papier recycl\u00e9\u201d ne sont pas obligatoires, mais sont, cependant, fortement conseill\u00e9es.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">D\u2019apr\u00e8s le <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000029958108\"><span style=\"font-weight: 400;\">d\u00e9cret num\u00e9ro 2014-1577 du 23 d\u00e9cembre 2014<\/span><\/a><span style=\"font-weight: 400;\">, la pr\u00e9sence du logo Triman est obligatoire, depuis le 1er janvier 2015, sur tous les produits relevant un consigne de tri.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">En cas de manquement \u00e0 cette obligation, une personne physique encourt une amende de 3000 euros et une soci\u00e9t\u00e9 une amende de 15000 euros.<\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>Les mentions l\u00e9gales li\u00e9es au produit<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Selon le produit mis en avant sur votre <\/span><b>flyer<\/b><span style=\"font-weight: 400;\">, il y a certaines <\/span><b>mentions l\u00e9gales <\/b><span style=\"font-weight: 400;\">suppl\u00e9mentaires \u00e0 ajouter.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>Les produits alimentaires<\/b><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">Pour la promotion d\u2019un produit alimentaire ou d\u2019une boisson, la loi de la Sant\u00e9 Publique impose qu\u2019une information a caract\u00e8re sanitaire soit inscrite. Exemples :<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">\u201cPour votre sant\u00e9, \u00e9vitez de manger trop gras, trop sucr\u00e9, trop sal\u00e9.\u201d ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">\u201cPour votre sant\u00e9, pratiquez une activit\u00e9 physique r\u00e9guli\u00e8re.\u201d ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">\u201cPour votre sant\u00e9, mangez 5 fruits et l\u00e9gumes par jour.\u201d etc.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>L\u2019alcool<\/b><\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">Les flyers faisant la promotion d\u2019un produit alcoolis\u00e9 doivent contenir la mention \u201cl\u2019abus d\u2019alcool est dangereux pour la sant\u00e9\u201d.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>L\u2019emploi de la langue fran\u00e7aise sur votre flyer<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Selon la <\/span><a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000000349929\/\"><span style=\"font-weight: 400;\">loi du 4 ao\u00fbt 1994<\/span><\/a><span style=\"font-weight: 400;\">, les <\/span><b>flyers<\/b><span style=\"font-weight: 400;\"> distribu\u00e9s en France doivent \u00eatre r\u00e9dig\u00e9s en fran\u00e7ais. Cependant, si vous souhaitez employer des mots ou phrases dans une langue \u00e9trang\u00e8re, vous devez les accompagner de leur traduction fran\u00e7aise.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: arial, helvetica, sans-serif;\">En cas de non-respect de cette obligation, vous vous exposez \u00e0 une amende de 750 euros.<\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>Les images utilis\u00e9es sur votre flyer<\/b><\/span><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">En ce qui concerne les images, vous devez vous assurer d\u2019\u00eatre en conformit\u00e9 avec les droits d\u2019auteur. Vous devez donc v\u00e9rifier si vous pouvez utiliser les photos dont vous n\u2019\u00eates pas l\u2019auteur.
